La Plataforma de Empleabilidad (en adelante, la "Plataforma") es una herramienta tecnológica dispuesta por Universidad de Concepción (en adelante, la "Institución"), operada sobre la infraestructura de Reqlut SpA (en adelante, "Reqlut"), con el propósito de fortalecer la empleabilidad, el desarrollo profesional y la vinculación con el entorno laboral de los estudiantes y egresados de la Institución. El acceso y uso de la Plataforma implica la aceptación íntegra de los presentes Términos y Condiciones.
For the purposes of these Terms, the following definitions apply: (i) Platform: the set of web features and employability intelligence services provided by the Institution on Reqlut's infrastructure; (ii) Student/Graduate User: the natural person who accesses the Platform in their capacity as a student or graduate of the Institution; (iii) Company User: the employing legal entity and the natural persons acting on its behalf (recruiters) who use the Platform to publish opportunities and manage selection processes; (iv) Content: all information, data, documents, CVs, job offers or material uploaded to or generated on the Platform.
To access certain features, the User must register by providing truthful, complete and up-to-date information. The User is responsible for keeping their credentials confidential, for the activities carried out from their account and for updating their information when necessary. The Institution may suspend or cancel accounts that contain false information or that breach these Terms.
The User undertakes to use the Platform diligently, lawfully and in accordance with its academic and professional purpose. It is prohibited to impersonate another identity, publish false or inaccurate information, interfere with or attempt to breach the security of the system, introduce malicious code, use automated data extraction tools (scraping) or transfer candidate information outside the Platform without authorization. Non-compliance may result in the suspension of access and in the corresponding legal actions.
The Company User undertakes to use the candidate information it accesses exclusively for legitimate recruitment and selection purposes, in accordance with the applicable personal data protection legislation. The Company User acts as an independent controller with respect to the personal data it collects and processes within its own selection processes, and undertakes not to sell, transfer or use such information for purposes other than those disclosed to the candidate. Reqlut may suspend or cancel company accounts that breach this obligation.
The Platform facilitates the interaction between candidates and organizations. Selection and hiring decisions are the exclusive responsibility of the employing entities. Neither the Institution nor Reqlut guarantee that employment will be obtained, nor do they take part in final hiring decisions.
The Platform, its software, source code, databases, design, trademarks and other elements are owned by Reqlut or by the Institution, as applicable, and are protected by the applicable intellectual property regulations. Use of the Platform does not transfer to the User any ownership right over those elements. Content uploaded by the User remains its property, granting the Institution and Reqlut a limited license to process it in order to provide the service.
The processing of personal data arising from the use of the Platform is governed by the Privacy Notice and by the Regulatory Annex of the corresponding country, which form an integral part of these Terms.
With respect to the data of students and graduates, Universidad de Concepción acts as Data Controller and Reqlut as Data Processor, limited to processing the data on behalf of and under the documented instructions of the Institution. With respect to the data of companies, employers and their representatives, Reqlut SpA acts as Data Controller.
Reqlut y la Institución procurarán mantener la Plataforma operativa de manera continua, sin perjuicio de interrupciones por mantenimiento, actualizaciones o causas de fuerza mayor. La Plataforma se provee "tal cual" y dentro de los límites permitidos por la ley; ni la Institución ni Reqlut responderán por daños indirectos, lucro cesante o decisiones de contratación adoptadas por terceros.
The Institution and Reqlut may modify these Terms to adapt them to regulatory, technical or operational changes. Any substantial modification will be reported to Users in a timely manner through the Platform. Continued use after the modifications take effect implies acceptance of them.
These Terms are governed by the laws of the Republic of Chile. Any dispute shall be submitted to arbitration under the Rules of the Arbitration and Mediation Center of the Santiago Chamber of Commerce (CAM Santiago), seated in Santiago, Chile, or to the ordinary courts of justice as agreed.
